I have been providing planning consultancy services for over 10 years and assist clients with a range of services. Working with clients I will recommend a strategy to navigate the planning process, with the aim of maximising the chances of securing planning permission and reducing the risk of non-compliance under the Planning and Building Law.
Working with clients I can prepare and manage planning applications. This service is only for small proposals, and relies on drawings being prepared by other professionals.
I provide pre-application planning advice and advice about the development potential of sites. Setting out a strategy for approaching the planning process, maximises the chances of securing planning permission. When necessary drawing upon expert planning legal counsel to provide robust advice to inform decision-making.
Working collaboratively with clients, architects and architectural agents I prepare Planning Statements to demonstrate that proposals are compliant with the Island Plan. It is helpful if I am involved at the beginning of the process and it is my experience that a robust Planning Statement helps strengthen any presentation to the Planning Committee or independent Planning Inspector if an appeal against a decision is lodged.
The planning system in Jersey requires applicants to provide clear accountability to decision-makers and neighbours about development proposals. I can liaise with neighbours and advise clients about strategies to engage with interested parties.
I am an experienced advocate at the Planning Committee and frequently appear on behalf of clients to assist with the presentation of applications. I can also help neighbours present objections to planning applications.
Decisions to approve planning permission often require the negotiation of a Planning Obligation Agreement (POAs), to be agreed with the Minister for Planning and Environment. I have negotiated the terms of POAs on behalf of many clients.
I have appeared as an expert Planning Witness at public inquiries and have experience co-ordinating and managing the public inquiry process. I have recently worked with a planning barrister managing the public inquiry for Retreat Farm and appearing as an Expert Witness providing expert advice about policy compliance.
I am able to assist clients with requests to review sites as part of the Island Plan Review process and am available to assist clients and organisations, which are seeking a review of Island Plan policies.
I am able to assist clients with the preparation of Masterplans and development plans.
Many proposals for development require assessment under Policy E1 and SPG: Protection of employment land. I regularly work with a local commercial agent to address the tests of these policies and we have a good track record in securing planning permission for schemes that fall to be considered under this policy test.
I can assist clients when there is an investigation by the Compliance Team of the Planning Department. I have helped clients respond to the serving of Enforcement Notices and the possibility of a Stop Notice being served.
